Terms of Service

Agreement
These Terms of Service ("Terms") govern your use of the Persist mobile app and website (together, the "Service"), operated by Persist ("Persist," "we," "us," or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Eligibility
You must be at least 18 years old to use Persist. By using the Service, you confirm that you meet this requirement and that the information you give us when you sign up is accurate.
Your Account
You are responsible for keeping your login credentials secure and for all activity under your account. Tell us promptly at persist.teamsupport@gmail.com if you believe your account has been accessed without your permission.
Trainers and Clients
Persist is an accountability tool that connects fitness trainers with their clients. Trainers invite clients, assign plans, and review check-ins; clients log their progress. Persist is not a party to the coaching relationship:
- Trainers are independent and solely responsible for the plans, advice, and guidance they provide. Persist does not employ, vet, or certify trainers.
- Clients decide for themselves whether to follow a trainer’s advice.
- Any agreement about services, fees, schedules, or refunds is between the trainer and the client.
Not Medical Advice
Nothing in Persist — including plans, check-in summaries, analytics, or AI-generated content — is medical advice. Consult a qualified health professional before starting any exercise or diet programme, particularly if you have a medical condition, injury, or are pregnant. Stop exercising and seek help if you feel pain, dizziness, or shortness of breath.
Payment Records
Trainers can record payments their clients owe or have made. These are records only: Persist does not process, hold, or transfer money, and does not collect card, bank, or UPI details. We are not responsible for the accuracy of payment records a trainer enters, and any payment dispute is between the trainer and the client.
Plans and Pricing
Persist is free for trainers managing up to 5 clients. Managing more than 5 clients requires a paid subscription. Clients do not pay to use Persist.
- The price and billing period are shown to you before you subscribe. We will not charge you without your agreement.
- If you subscribe through the Apple App Store, payment, renewal, cancellation, and refunds are handled by Apple under its terms, and you manage the subscription in your Apple account settings.
- If you cancel, your subscription stays active until the end of the period you have paid for. When that period ends, your access to clients beyond the free plan’s limit of 5 stops.
- If we change subscription prices, we will tell you in advance, and the change will apply from your next billing period, not retroactively.
Payments for subscriptions are separate from the trainer–client payment records described above: a subscription is paid by a trainer for use of Persist, while payment records only track what clients owe their trainer.
Your Content
You own the content you put into Persist — check-ins, meal photos, messages, plans, and other material ("Your Content"). You give us a limited licence to store, process, and display Your Content only as needed to operate the Service, including showing it to the trainer or client you are linked with. You are responsible for having the rights to anything you upload, including plan documents you share with clients.

Acceptable Use
When using Persist, you agree not to:
- Harass, threaten, or abuse another user, or send unlawful, obscene, or hateful content.
- Upload content you do not have the right to share, or that infringes someone else’s rights.
- Access another user’s data without authorisation, or attempt to bypass the Service’s security or usage limits.
- Reverse-engineer, scrape, overload, or otherwise disrupt the Service.
- Use the Service for any unlawful purpose.
AI Features
Some features use AI to interpret what you enter — for example, turning a typed workout description into structured data. AI output can be wrong. Review it before relying on it; you remain responsible for what you save.
Suspension and Termination
You can stop using Persist at any time and request deletion of your account by contacting persist.teamsupport@gmail.com. We may suspend or close an account that breaches these Terms or puts other users or the Service at risk. Where reasonable, we will tell you why.
Disclaimers
The Service is provided "as is" and "as available." To the extent permitted by law, we make no warranties that the Service will be uninterrupted, error-free, or that data will never be lost. Reminders and notifications may be delayed or fail to arrive, and should not be relied on for anything time-critical.
Limitation of Liability
To the maximum extent permitted by law, Persist is not liable for any indirect, incidental, or consequential loss, or for any injury, loss, or dispute arising from a trainer's advice, a client's training, or a payment arrangement between them. Nothing in these Terms limits liability that cannot be limited under applicable law.
Governing Law
These Terms are governed by the laws of India. Any dispute arising from them is subject to the exclusive jurisdiction of the courts in Maharashtra, India.
Changes to These Terms
We may update these Terms as Persist evolves. If we make material changes, we will update the effective date at the top of this page and, where appropriate, notify you in the app. Continuing to use Persist after a change means you accept the updated Terms.
